Potter County Republican Party Chairman Dan Rogers has sued the Potter County Elections Administrator on behalf of the County Republican Party, court records show.
The federal-court lawsuit seeks a court order requiring the county to hand count all votes cast in the November midterm election “for comparison with the machine-based reported election results.”
The lawsuit’s scope isn’t limited to Potter County, as it seeks a full hand count of “all paper election records or ballots in all precincts in Texas.” Potter County Elections Administrator Cristy Benge is named as “representative of a defendant class of similarly situated Texas county election officials.”
Rogers has long been a vocal critic of electronic voting systems and has advocated for “hand-marked self-authenticating paper ballots.”
Current law requires a portion of votes using electronic voting machines to be manually counted, though Rogers alleges in his lawsuit this is not enough. “Wrongdoers, foreign or domestic, can use AI to interfere with the upcoming federal election by altering the final vote for candidates from the candidate selection of legal citizens, in the absence of a full verification,” Rogers writes in his complaint.
Rogers is represented in the lawsuit by Houston-based Woodfill Law Firm.
