Canyon Commissioners to Consider Shrinking City Limits & ETJ

The Canyon City Commission will consider items set to reduce its city limits and extraterritorial jurisdiction on Monday.

According to the packet for the meeting, the property being disannexed is owned by Allen Ebankamp. The property, located on Soncy Rd in the northern part of the city, was annexed to create the Mayra Park subdivision last year.

“Ebenkamp was assured he would not be required to annex,” notes the packet. However, the annexation was completed before Ebankamp was deeded the property, meaning the property was annexed regardless.

The total area set to be disannexed “total just over a quarter-acre,” according to the city.

Later in the meeting, the commission is set to consider an item to remove just under 40 acres from the city’s extraterritorial jurisdiction. The property is split across two tracts, both of which are owned by RBJ Real Estate, LLC. Both tracts are located near where US 87 splits from Interstate 27 just north of the city.

According to the city, state law has two provisions regarding a reduction in a city’s ETJ. One provision requires land be removed if the land owner obtains a certain number of petition signatures, while another requires the city to give consent to reduce the ETJ. The owner of the property did petition for the properties to be removed.

“To ensure clarity and effectiveness, City Staff recommends that the City Commission adopt Ordinance No. 1206, to remove the real property described in the submitted petition from the ETJ of Canyon,” notes the city.

One other noteworthy item on the agenda is a presentation on the city’s Community Investment Plan.
